Fed. Circ. Partly Revives Challenge To Medline Catheter IP

Law360 (August 13, 2021, 8:32 PM EDT) — The Federal Circuit on Friday gave C.R. Bard Inc. another chance to fight Medline Industries Inc. catheter tray patents at the Patent Trial and Appeal Board, saying the board needs to take another look at whether many of the challenged patent claims were invalid.

A three-judge panel partially reversed and partially upheld various decisions from the PTAB not to invalidate a host of claims in three Medline patents: U.S. Patent Nos. 9,745,088; 9,808,596; and 9,795,761.
