The State Administration for Market Regulation (SAMR) issued the “Measures for the Supervision and Administration of Cosmetics Production and Operation” on August 2, 2021. The Measures will come into effect on January 1, 2022. This is China’s first departmental regulation specifically for the production and management of cosmetics. Supporting the parent decree, the “Regulations on the Supervision and Administration of Cosmetics”, it stipulates cosmetics production licensing, production management, operation management, and legal responsibilities:
Production Licensing System
The measures clarify that cosmetics registrants, recorders, and entrusted manufacturing enterprises should establish a cosmetics production quality management system and ensure continuous and effective operation. At the same time, it maintains that the workshop and other places shall not store and produce products that harm the quality of cosmetics.
Purchasing Record System
The measure point out that cosmetics operators should check the registration certificate of the direct supplier, the special cosmetics registration certificate or the record information. The quality inspection certificate shall be kept ensuring the quality and safety of the cosmetics.
Production License for Renewal and Change
The measures implements the “notification and commitment” system for the renewal of cosmetics production licenses. The validity period of the production license is increased to 5 years for production license change.
