California Company Alleges Nintendo Infringing on Patented Technology Without License

On April 8th, 2020, a California-based company called Gamevice, Inc. filed a lawsuit against Nintendo of America, Inc. in the United States District Court for the Central District of California. The lawsuit alleges that Nintendo has been infringing on Gamevice’s patented technology without a license.

Gamevice is a company that manufactures and sells gaming accessories, such as the Wikipad tablet and the Gamevice controller. The lawsuit alleges that Nintendo has been infringing on Gamevice’s patented technology by using it in their Nintendo Switch console and Joy-Con controllers. Specifically, the lawsuit claims that Nintendo has infringed on Gamevice’s patent for a “Combination Computing Device and Game Controller with Flexible Bridge Section” (U.S. Patent No. 9,126,119).

The lawsuit seeks to stop Nintendo from using the patented technology without a license and to recover damages for the alleged infringement. It also seeks to recover attorney’s fees and costs associated with the lawsuit.

This is not the first time that Gamevice has accused Nintendo of infringing on its patents. In 2017, Gamevice filed a similar lawsuit against Nintendo in the United States District Court for the Northern District of California. That case was ultimately dismissed in 2018 after the parties reached a confidential settlement agreement.

It remains to be seen how this latest lawsuit will play out. However, it serves as an important reminder of the importance of protecting intellectual property rights. Companies should make sure that they have the proper licenses and authorizations in place before using another company’s patented technology. Otherwise, they may find themselves facing costly litigation.
